Inherited home & Prop 19 in La Jolla

California Board of Equalization Prop 19 basics for parent-to-child and inherited family homes — what the Assessor publishes, what to confirm with tax counsel, and when to bring Weston into the real-estate timeline.

Inheriting a La Jolla or coastal San Diego home is usually two tracks at once: property-tax / Assessor rules under Prop 19, and whether and how to sell or keep the place. This page cites BOE and San Diego County ARCC materials for the public Prop 19 framework. It does not decide whether any transfer qualifies, invent a tax-savings number, or publish a commission rate.

Two Prop 19 tracks

Prop 19 is often discussed as one topic. For sellers and heirs it usually splits into:

1. Intergenerational transfer exclusion — keeping a lower factored base year value when a family home (or family farm) transfers between parents and children (operative February 16, 2021). This is the inherited / parent-child path most people mean first. (BOE pub801)

2. Base year value transfer (replacement home) — an owner who is over 55, severely disabled, or a wildfire / natural-disaster victim transferring the factored base year value to a replacement primary residence anywhere in California within two years of selling the original (beginning April 1, 2021). Settlement-fee context: cost to sell. (BOE LTA 2024/044; Rule 462.540)

You can face both in one life event (inherit, then later sell and buy). Treat them as separate Assessor claims with separate forms and deadlines.

Parent-to-child / inherited family home

Operative February 16, 2021, Prop 19 frames an exclusion from change in ownership for transfer of a family home or family farm between parents and children (and, under limited conditions, grandparents and grandchildren), allowing retention of the transferor’s taxable (factored base year) value subject to published limits (Cal. Const. art. XIII A, §2.1(c)–(e); RTC §63.2). Source: BOE pub801 · BOE Prop 19 hub.

Key BOE points (not a qualification determination): the transferee must live in the home as primary residence within one year and file the homeowners’ or disabled veterans’ exemption within one year for exclusion from the transfer date (late exemption filing → prospective relief).

Value limit: excluded amount = taxable value at transfer plus a BOE-adjusted allowance. For transfers February 16, 2025 through February 15, 2027, that adjusted allowance is $1,044,586 (LTA 2025/009, March 7, 2025; pub801). Amounts above taxable value + allowance are added to taxable value. File BOE-19-P with the County Assessor. County: ARCC parent-child exclusion.

What to confirm with tax counsel

Bring these to a CPA, tax attorney, or estate attorney (and the County Assessor as needed). Weston does not give tax advice.

  • Whether the transfer is a change in ownership under Prop 13 / Prop 19 for this vesting and deed history.
  • Whether the property meets the BOE definition of a family home (or farm) for the intergenerational exclusion — and whether the one-year residency / exemption filing can be met.
  • How the $1,044,586 allowance (Feb 16 2025–Feb 15 2027) interacts with current taxable value and fair market value — Assessor math, not a blog calculator.
  • Federal income-tax issues (basis, gain) are separate from the California property-tax exclusion — do not mix them on a settlement estimate.
  • Timing of BOE-19-P (or BOE-19-G) vs listing, escrow, and move-in.
  • If a later sale + replacement purchase is planned: base year value transfer eligibility, two-year window, and claim deadlines (LTA 2024/044).
  • Trust, probate, or multiple-heir coordination — who signs, who occupies, who sells.

Decision timeline with Weston

A practical order many La Jolla heirs use — adjust with counsel. Real estate and tax are separate tracks.

1 · Authority. Deed / vesting / probate or trust authority clear enough to act — estate counsel / trustee.

2 · Assessor path. Prop 19 intergenerational claim (BOE-19-P, residency, exemption) — Assessor + tax counsel.

3 · Keep vs sell. Place, condition, coastal/permit diligence — heirs + Weston (market/process) + counsel (tax).

4 · If selling. Seller file, disclosures, pricing — Weston · see seller prep.

5 · Settlement picture. Public fees + title/escrow categories — Weston + escrow · see cost to sell. No commission rate on this site.

6 · If buying a replacement. Base year value transfer claim timing — tax counsel + Assessor; Weston on purchase/sale coordination.

Replacement-home transfer (short pointer)

If the plan is to sell the inherited (or long-held) primary residence and buy another California primary residence, the over-55 / disabled / disaster base year value transfer may apply beginning April 1, 2021: transfer the factored base year value to a replacement primary residence anywhere in California purchased or newly constructed within two years of the sale (LTA 2024/044; Rule 462.540). Claims generally file with the County Assessor within three years of purchase or completion of the replacement dwelling.

Brokerage compensation is discussed directly with Weston for the specific listing. sandiego.homes does not publish, invent, or imply a commission rate on this page.

FAQ

What is Prop 19 for an inherited or parent-to-child family home?

Operative February 16, 2021, Prop 19 frames an exclusion from change in ownership for transfer of a family home or family farm between parents and children (and, under limited conditions, grandparents and grandchildren), allowing retention of the transferor’s taxable factored base year value subject to published limits. See BOE pub801 and the San Diego County ARCC parent-child exclusion page. Qualification is fact-specific.

What is the current BOE value allowance for parent-to-child transfers?

For transfers from February 16, 2025 through February 15, 2027, BOE LTA 2025/009 and pub801 state an adjusted allowance of $1,044,586. The value cap is the property’s factored base year value plus that allowance; amounts above that sum are added to taxable value. This is general BOE information, not a determination that any transfer qualifies.

How is the replacement-home Prop 19 transfer different?

Beginning April 1, 2021, an owner of a primary residence who is over 55, severely disabled, or a victim of a wildfire or natural disaster may transfer the factored base year value to a replacement primary residence anywhere in California purchased or newly constructed within two years of the sale of the original property. File with the County Assessor; see BOE LTA 2024/044. Closing-fee context: /cost-to-sell-la-jolla.

What should heirs confirm with tax counsel before listing?

Whether the transfer qualifies for the intergenerational exclusion, how the BOE allowance interacts with taxable value and fair market value, federal basis/gain issues (separate from property tax), BOE-19-P timing, and — if a replacement purchase is planned — base year value transfer eligibility and deadlines. Weston does not give tax advice.

When should heirs talk with Weston?

Once vesting authority is clear enough to act, and in parallel with Assessor/counsel work if a sale is likely. Weston leads seller prep, pricing, buyer diligence, and settlement coordination — not Assessor outcomes. Start with /seller-prep and call (858) 997-8998.

Does this page publish commission rates or tax savings examples?

No. Brokerage compensation is discussed directly with Weston for the specific listing. This site does not invent commission rates, co-op figures, or dollar tax-savings examples for any property.
